The Supplier Data used to provide this Dataset is supplied by GBG’s Supplier. GBG is obliged under the terms of its agreement with its Supplier to ensure that all End Users agree to comply with the following licensing provisions

1. USE OF THE DATASET
1.1 The End User acknowledges that the information this Dataset provides to the End User may contain consumer identification information governed by Gramm-Leach-Billey Act (“GLBA”). In accordance with the GLBA, the End User certifies its purposes for requesting such information is necessary for (i) the completion of a transaction authorized by the consumer including but not limited to the collection of delinquent accounts; and (ii) fraud detection and prevention
1.2 The End User acknowledges that the Dataset may also contain driver’s licence and motor vehicle registration information subject to the protections of the Driver’s Privacy Protection Act (DPPA). In accordance with DPPA, the End User certifies that its purposes for requesting such information is necessary for use in the normal course of business, to verify the accuracy of personal information submitted by the individual to the business and, if the submitted information is incorrect, to obtain correct information, but only for the purpose of preventing fraud by, or pursuing legal remedies against, or recovering on a debt or security interest against, the individual. 18 U.S.C. § 2721 (b)(3)
1.3 The End User shall maintain copies of all written authorizations regarding the uses detailed in clause 2.1 and 2.2 for a minimum of five years from the date of inquiry.
1.4 The End User with the following limitation on the use of data provided by this Dataset:
(a) not to use this Dataset for any “permitted purpose” covered by the Fair Credit Reporting Act (15 U.S.C. Sec. 1681 et seq.) (“FCRA”) or use any of the information it receives through this Dataset to take any “adverse action”, as that term is defined in the FCRA
(b) not to use this Dataset in violation of the Drivers Privacy Protection Act (18 U.S.C. Section 2721 et seq.);
(c) Not to use this Dataset other than pursuant to an exception to the privacy provisions of the Gramm-Leach Biley Act (15 U.S.C. Sec. 6801 et seq.);
(d) not to use the Dataset or submit any consumer data to GBG in violation of any applicable laws related to the collection and disclosure of scanned state issued identity documents and, where required by applicable law, to obtain appropriate consent from any individual who submits their data to GBG in the course of GBG providing the Dataset. 
(e) not to use this Dataset in violation of such other legislation that may be enacted in the future that GBG determines limits the use of the Dataset by the End User. 
1.5 The End User shall not use the information gathered through the Dataset for marketing purposes
1.6 That End Users are prohibited from further reselling or licensing the Non-FCRA Services to other third parties. 

2. Limitation of Liability
2.1 IN NO EVENT WILL ANY SUPPLIER USED BY GBG BE LIABLE FOR SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, LOST PROFITS OR REVENUES), LOST OR CORRUPTED DATA OR OTHER LIABILITY ARISING OUT OF OR IN ANY MANNER IN CONNECTION WITH THIS DATASET, THE PERFORMANCE OR BREACH HEREOF, THE SUBJECT MATTER OF THIS DATASET, OR END USER’S USE OF, OR INABILITY TO USE, THIS DATASET, ANY INFORMATION OR DATA PRODUCED BY THIS DATASET OR ANY OTHER INFORMATION, DATA OR MATERIALS PROVIDED TO THE END USER HEREUNDER, REGARDLESS OF THE FORM OF ACTION (INCLUDING STRICT LIABILITY OR NEGLIGENCE), WHETHER OR NOT THEY HAVE BEEN ADVISED, OR OTHERWISE MIGHT HAVE ANTICIPATED THE POSSIBILITY, OF SUCH DAMAGES. END USER AGREES THAT GBG’S SUPPLIER’S AGGREGATE LIABILITY FOR ANY AND ALL LOSSES OR INJURIES ARISING OUT OF OR IN CONNECTION WITH ANYTHING TO BE DONE OR FURNISHED UNDER THIS DATASET SHALL NEVER EXCEED $100
