• GBG hosts the Supplier Data
• The Supplier does not receive any personal data

The Supplier Data used to provide Hong Kong Address Data S58 is obtained from GBG’s Supplier. GBG is obliged under the terms of its agreement with its Supplier to ensure that all End Users agree to comply with the following provisions:

1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms and Product Terms:
“End User Data” means any data provided to GBG by the End User for processing in accordance with the terms of the Agreement including where relevant any personal data.
“Government” means the Office of the Government Chief Information Officer of the Government of the Hong Kong Special Administrative Region.
“Permitted Purpose” means the purposes, restrictions and or conditions for the use of the Dataset outlined by the Supplier as set out in clauses 2.3 – 2.4 below, in addition to the Customer Use Case set out in the Agreement and at clause 2.1.

2. USE OF THE DATASET
2.1. This Dataset may only be used for the Customer Use Cases detailed below, provided that such Customer Use Case is selected on the End User's Order Form and the End User complies with any use case restrictions set out in the Agreement or these Additional Terms:

2.2. In addition to the Customer Use Case restrictions contained within clause 2.1 (including any conditions that apply to that Customer Use Case) the following terms set out in clauses 2.3-2.4 also apply
2.3. The End User shall clearly identify the source of the Supplier Data and give proper attribution to the Government and DATA.GOV.HK.
2.4. The End User acknowledges and accepts the Government is the owner of the Intellectual Property Rights in the Supplier Data and in all copies including but not limited to paper copies, digital copies and copies placed on any websites.
2.5. The End User warrants that it will not use the Dataset for any reason outside the Customer Use Case and Permitted Purpose.

3. INDEMNIFICATION
3.1. The End User agrees to indemnify, defend and hold GBG harmless from any allegations or claims of infringement of any third-party rights and all costs, losses, damages and liabilities arising directly or indirectly from the End User’s use, reproduction and/or distribution of the Supplier Data.

4. EXCLUSION OF WARRANTIES AND LIABILITY
4.1. The Supplier Data are provided on an “as is” basis. No statement, representation, or warranty of any kind (whether express or implied) is given in relation to the Supplier Data (including the accuracy, completeness, non-infringement, reliability, security, timeliness, and appropriateness of the Supplier Data for use in any particular circumstances).
4.2. GBG and the Government shall not be liable for any errors, omissions, misstatements, or misrepresentations (express or implied), concerning the Supplier Data, and shall not be liable for any loss, destruction or damage (including without limitation consequential loss, destruction or damage) howsoever arising from or in respect of any use or misuse of or reliance on the Supplier Data, or any inability to use the Supplier Data.

5. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
5.1. GBG does not transfer End User Data to the Supplier to provide this Dataset.
