- The Supplier does not receive any personal data
The Supplier Data used to provide Australia Geo S59 Dataset is obtained from GBG’s Supplier. GBG is obliged under the terms of its agreement with its Supplier to ensure that all End Users agree to comply with the following provisions:
1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms and Product Terms:
“End User Data” means any data provided to GBG by the End User for processing in accordance with the terms of the Agreement including where relevant any personal data.
“Permitted Purpose” means the purposes, restrictions and or conditions for the use of the Dataset outlined by the Supplier as set out in clauses 2.3 – 2.4 below, in addition to the Customer Use Case set out in the Agreement and at clause 2.1.
2. USE OF THE DATASET
2.1. This Dataset may only be used for the Customer Use Cases detailed below, provided that such Customer Use Case is selected on the End User's Order Form and the End User complies with any use case restrictions set out in the Agreement or these Additional Terms:

2.2. In addition to the Customer Use Case restrictions contained within clause 2.1 (including any conditions that apply to that Customer Use Case) the following terms set out in clauses 2.3-2.4 also apply.
2.3. The End User shall not use the Supplier Data for the generation of an address or a compilation of addresses for the sending of mail unless the End User has verified that each address to be used for the sending of mail is capable of receiving mail by reference to a secondary source of information other than the Supplier Data.
2.4. The End User acknowledges and accepts the Supplier Data is subject to some open source licences. The End User must comply with those open source licences mentioned here (as amended from time to time): https://geoscape.com.au/legal/data-copyright-and-disclaimer/.
2.5. The End User warrants that it will not use the Dataset for any reason outside the Customer Use Case and Permitted Purpose.
3. EXCLUSION OF WARRANTIES AND LIABILITY
3.1. The Supplier Data are provided on an “as is” and “as-available” basis. No statement, representation, or warranty of any kind (whether express, implied, statutory or other) is given in relation to the Supplier Data (including without limitation any warranties of title, merchantability, fitness for a particular purpose, non-infringement, absence of latent or other defects, accuracy, or the presence or absence of errors, whether or not known or discoverable).
3.2. In no event will GBG and the Supplier be liable to the End User on any legal theory (including, without limitation, negligence) or otherwise for any direct, special, indirect, incidental, consequential, punitive, exemplary, or other losses, costs, expenses, or damages arising out of the use of the Supplier Data and/or Dataset, even if the End User has been advised of the possibility of such losses, costs, expenses, or damages.
4. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
4.1. GBG does not transfer End User Data to the Supplier to provide this Dataset.
