• GBG hosts the Supplier Data.
• No personal data is transferred to the Supplier.

The Supplier Data used to provide Addressbase Core– Consumer Solutions is supplied by GBG’s Supplier, Ordnance Survey. GBG is obliged under the terms of its agreement with its Supplier to ensure that all End Users agree to comply with the following provisions. These Additional Terms apply to all AddressBase Core – Consumer Solutions Datasets. Individual AddressBase Core – Consumer Solutions Datasets can be identified using the ID Number listed on the End User’s Order Form:

1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms and Product Terms:
“Cached Data” means data which is downloaded and stored by Caching.
“Caching” means the automatic, immediate download and temporary storage of data as an integral and essential part of a technological process.
“Coordinate” means coordinates plotted on the National Grid but shall not include any coordinates created using AddressBase Premium – Islands.
“Device” means a personal computer, mobile telephone handset or other device designed for use by a single user at any one time.
“End User Data” means any data provided to GBG by the End User for processing in accordance with the terms of the Agreement including where relevant any personal data
“End User Generated Content” means content generated by the End User in the course of using an Online Solution or an Offline Solution consisting of: a) any line, polygon, symbol or text that copies or represents, or which is used to infer the position of, any feature depicted in the Supplier Data; and/or b) measurements and distances determined using the Supplier Data; and/or c) routes created by selecting and linking a series of co-ordinates plotted on and/or using the Supplier Data incorporated in GBG product and/or Service. End User Generated Content is treated as Supplier Data. In no circumstances may End User Generated Content be created using AddressBase Premium – Islands.
“Navigation Product” means a GBG product and/or service which may be used on a Device and provides the End User with turn by turn instructions (based on and automatically updated to reflect the Device’s position and movement during the journey) on how to get to a destination.
“Offline Solution” means a GBG product and/or Service (which, for the avoidance of doubt, can include Navigation Products) that permits the storage of Supplier Data by the End User.
“Online Solution” means a GBG product and/or Service that: a) is hosted by GBG (or on behalf of GBG) through which the End User is able to access the Supplier Data b) permits the storage of Coordinates, Cached Data and End User Generated Content (but no other Supplier Data) on any Device but does not permit any such storage of any data created using AddressBase Premium – Islands; and c) where the Supplier Data is AddressBase Premium – Islands, only permits access to Supplier on a viewing only basis. remotely;
“Permitted Purpose” means the purposes outlined by the Supplier for which the Dataset may be used as set out in clauses 2.3 to 2.9 and clause 5 below as applicable to the End User in addition to the Customer Use Case set out in the Agreement and at clause 2.1.
“Session” means a period of time commencing when the End User accesses the Supplier Data through an Online Solution and expiring as soon as one of the following occurs: a) the End User navigates away from or ceases to be connected to the Online Solution; or b) 24 hours have passed since commencement.
“Subscription Period” means a period of time as agreed by GBG and the End User for which the End User is signed up, comprising whole units of one year, one month and/or one week.

2. USE OF THE DATASET
2.1. This Dataset may only be used for the Customer Use Cases detailed below, provided that such Customer Use Case is selected on the End User's Order Form and the End User complies with any use case restriction set out in the Agreement:
• Data Quality
2.2. In addition to the Customer Use Case restrictions contained within clause 2.1 (including any conditions that apply to that Customer Use Case) the following terms set out in clauses 2.3-2.9 also apply.
2.3. The End User is granted a non-exclusive, non-transferable licence to use the Supplier Data (i) in the Offline Solution(s) on a perpetual basis or for the Subscription Period (as set out in the Order Form); and (ii) in the Online Solution(s) for the Subscription Period or, where applicable, the Session. The End User is granted a perpetual licence to use End User Generated Content and/or Coordinates stored on the End User’s Device.
2.4. The Dataset cannot be used for the End User’s trade, business or profession.
2.5. The End User shall not store Cached Data for more than 24 hours after the end of any Session or the Subscription Period.
2.6. The End User is entitled to create End User Generated Content and/or Coordinates but only for the Permitted Purpose.
2.7. The End User shall not download, store or extract the Supplier Data except to the extent otherwise provided for in these Additional Terms.
2.8. The End User is entitled to print the Supplier Data (other than AddressBase Premium – Islands) for his or her personal (non-commercial) use. For the sake of clarity, the use of prints for the purposes of planning permission applications is not permitted.
2.9. When the Supplier Data is provided for trial and testing purposes, the End User acknowledges and accepts that the Supplier Data is provided on a viewing only basis.
2.10. The End User warrants that it will not use the Dataset for any reason outside of the Customer Use Case and Permitted Purpose.

3. LIABILITY
3.1. The Supplier shall have no liability to the End User in respect of the Supplier Data, the End User Generated Content, or these Additional Terms.

4. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
4.1. GBG does not transfer End User Data to the Supplier to provide this Dataset.

5. MISCELLANEOUS
5.1. The Dataset contains Intellectual Property Rights owned, in part, by Royal Mail. Accordingly, the Dataset is subject to the additional specific terms set out in the following documents: (a) the Royal Mail Digital Mapping Agreement (https://licensing-centre.poweredbypaf.com/files/documents/Digital-Mapping-and-Location-Display-Licence-Agreement-v2-1-April-2017.pdf) in respect of the use of the Dataset in the Offline Solution(s) and (b) the Royal Mail PAF Solutions Provider Licence (https://www.poweredbypaf.com/licence-our-products/licence-agreements/solutions-providers/) in respect of the use of the Dataset in the Online Solution(s) and AddressBase Premium – Islands.
5.2. The terms of the Royal Mail Digital Mapping Agreement and the Royal Mail PAF Solutions Provider Licence are incorporated to these Additional Terms by reference.
5.3. GBG excludes all liability with the End User in relation to such licences.
5.4. Where there is any conflict between the terms of the Royal Mail Digital Mapping Agreement and/or the Royal Mail PAF Solutions Provider Licence and the terms of the General Terms (including these Additional Terms and the Product Terms), the Royal Mail Digital Mapping Agreement and/or the Royal Mail PAF Solutions Provider Licence shall take precedence.
5.5. GBG may automatically terminate the Agreement upon termination of the agreement between GBG and the Supplier. For the avoidance of doubt, the End User will cease using the Supplier Data upon termination or expiry of the agreement between GBG and the Supplier, unless otherwise expressly agreed under these Additional Terms.
