The Supplier Data used to provide UK Consumer Affordability is provided by GBG’s Supplier, Equifax Ltd. The Intermediary must ensure that it complies with the following terms:

1.1 The Intermediary must not share the Results with End Users who are:
• Adult Entertainment services of any kind (with the exception of identity and age verification services);
• Companies that handle physical third part possession
• Companies that locate missing children
• Dating Services
• Massage Services
• Tattoo Services
• Companies that charge advance fees for debt or mortgage assistance relief (excluding refinancing of a dwelling loan or services offered by attorneys)
• Private investigation or detective services (excluding assisting with pre-employment services with written consent)
• Credit repair clinics or any type of company involved in credit repair

1.2 The Intermediary shall comply at all times with Applicable Laws. For the purposes of this clause Applicable Laws means all applicable laws, enactments, rules, regulations, orders, regulatory policies, regulatory permits and licences, and any mandatory instructions or requests of a regulator, in each case which are in force from time to time, including:
• The Consumer Credit Acts 1974 and 2006;
• The Data Protection Act 2018;
• The Representation of the People (England and Wales) Regulations 2001;
• The Financial Services and Markets Act 2000 (Money Laundering Regulations 2001);
• Rules made by the Steering Committee on Reciprocity; and
• The Guide to Credit Scoring 2000

1.3 The Intermediary shall at all times maintain:
(a) a complete and up to date list of all End User’s to whom the Intermediary supplies the Service or has supplied the Service and shall provide a copy of that list to GBG and Equifax promptly on request; and
(b) their own audit trail to satisfy any consumer enquiries coming direct to them (or any End User) including (if necessary) details regarding the lawful condition for processing and personal data and shall provide such information to GBG or Equifax promptly upon request.
