• GBG hosts the Supplier Data
• No Sub-processors used

The Supplier Data that GBG uses to provide German Suppression Services is supplied by GBG’s Data Supplier. GBG is obliged under the terms of its agreement with its Data Supplier to ensure that all End Users agree to comply with the following provisions:

1. USE OF THE SUPPLIER DATA
1.1 The End User may only use the Supplier Data to update, report on or validate data already in the End User’s possession, and only for the End User’s internal business use. Any further or deviating use requires the explicit consent of the Data Supplier.
1.2 The Supplier Data may not be extracted, copied, disclosed or provided to, or made available as raw data, to any third party, or published in any format (including on the internet).
1.3 The End User shall be responsible for ensuring that its use of the Supplier Data is legally permissible. The End User shall not be entitled to save the addresses contained within the Supplier Data for longer than the temporary storage period of 12 weeks, or to save the Supplier Data in any other form. After the agreed period of usage, the End User must immediately delete the Supplier Data.
1.4 The Data Supplier shall update the Supplier Data at regular intervals in line with the industry standard. The Data Supplier’s provision of the Supplier Data is reliant on third parties and no guarantee is given that the Supplier Data is error-free. The End User acknowledges that the Supplier Data is provided “as is” and that no warranties of any kind are provided.
1.5 The Data Supplier is entitled to adapt, enhance or modify the Supplier Data or its structure.

2. LIABILITY
2.1. Notwithstanding the liability of the End User to GBG as set out in the General Terms, under the terms of GBG’s agreement with its Data Supplier, in the event of unauthorised or misuse of the Supplier Data or breach of these terms, the End User undertakes to pay a contractual penalty of 10 times the amount of the charge for use of the Supplier Data and this element of the Service.

3. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
3.1. GBG does not use Sub-processors to provide this element of the Service as the Supplier Data is hosted locally by GBG.

4. SUSPENSION AND TERMINATION
4.1. Notwithstanding the termination provisions between GBG and the End User in the General Terms, under the terms of GBG’s agreement with its Data Supplier, the supply of Supplier Data can be terminated on 3 months’ notice.
4.2. The Data Supplier reserves the right to suspend access to the Supplier Data in the event of misuse and/or insufficient reporting regarding use of the Supplier Data.
