The Supplier Data that GBG uses to provide Brazil Address Data is taken from the Diretorio Nacional de Enderecos (DNE) which is the National Directory of Addresses and is supplied by GBG’s Data Supplier Empresa Brasileira de Correios e Telegrafos. GBG is obliged under the terms of its agreement with the Data Supplier to ensure that all End Users agree to comply with the following provisions:
1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms:
“Permitted Purpose” means use of the Supplier Data:
a) within software for the processing of addresses and marketing in the corporate market;
b) the provision of address entries sanitization services (oneshot or online);
c) publication of address guides;
d) validation, cleansing and deduplication of address entries records;
e) geographical location (geomarketing);
f) customer service call centers;
g) access to the internet or intranet;
h) managing the relationship with customers;
i) capture of addresses; and
j) enterprise resource planning.
2. USE OF THE SERVICE
2.1. The End User may only use the Supplier Data for the Permitted Purpose in accordance with these Additional Terms.
If the Supplier Data is used outside of the Permitted Purpose, the End User acknowledges that such use will be subject to the following rules and penalties: Antipiracy, Law 10695, dated 07/01/2003, Copyright, Law 9610, dated 02/19/1998 and Intellectual Property, Law 9279, dated 05/14/1996, in all its extensions, regardless of any judicial or extrajudicial interpellation.
3. INTELLECTUAL PROPERTY RIGHTS
3.1 The DNE is considered a new and original intellectual work, in accordance with the Brazilian Copyright Law No. 9610/1998. This invention is a database whose economic rights of the author are under the exclusive property of the Data Supplier including by virtue of article 2, paragraph 1, b; article 8, item II and article 15, paragraph 1 of Law 6538/78, and may be licensed by means of direct hiring, as supported in the caput of article 25 of Law No. 8666/93.
3.2 Where an End User is explicitly permitted in its Agreement with GBG to publish or otherwise share the Supplier Data with any other third party (for example as an authorised reseller or channel partner), the End User must ensure that all additional End Users who receive or access the Supplier Data receive a copy of these Additional Terms and associated copyright notices.
4. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
4.1 GBG does not use Sub-processors to provide this element of the Service as the Supplier Data is hosted by GBG.
