The Supplier Data that GBG uses to provide GAS Reactive Data (GASR) and New Occupier Data is supplied by GBG’s Data Supplier. GBG is obliged under the terms of its agreement with the Data Supplier to ensure that all End Users agree to comply with the following provisions:
1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms:
“Permitted Purpose” the use of GASR for identity management, verification and/ or validation of the identity of individuals subject to the terms of the Agreement and these Additional Terms
“GASR” means the Goneaway Suppression Reactive service which is the suppression of addresses of individuals who have moved providing by way of a permanent flag the relocation address of the individual who has moved (“Relocation”) and, if available the name of the new occupier in the address from which the individual have moved (“New Occupier”)
2. USE OF GASR
2.1. The End User may only use GASR for the Permitted Purpose in accordance with these terms.
2.2. The End User may only use GASR for the internal purpose of screening, cleaning and enhancing the End User’s database.
2.3. The End User must not under any circumstances use GASR:
2.3.1 on any laptop or other such portable computer;
2.3.2 for the purpose of assessing creditworthiness;
2.3.3 for sub-licensing selling or otherwise disclosing or making available GASR to any third party acting as a credit reference agency or as a supplier of information used for assessing creditworthiness;
2.3.4 in the case of Relocations and New Occupiers for contacting anyone other than an existing customer of the End User; or
2.3.5 for debtor tracing unless there is a pre-existing relationship with the customer.
2.4. The End User may not make GASR available to any third party directly or indirectly, in any manner whatsoever, including but not limited to by way of incorporation into a software package.
2.5 The End User warrants that it will only use the Supplier Data in relation to individuals with which it has an existing relationship.
3. LIABILITY
3.1. Notwithstanding the liability of the End User to GBG as set out in the General Terms, the Data Supplier shall not be liable for (a) in any circumstances loss or damage arising from any inaccuracies or faults in, or omissions from, or otherwise from the provision of GASR, unless caused by the Data Supplier’s negligence or willful default and (b) in any circumstances (including, without limitation, if the Data Supplier has been negligent or in breach of statutory duty) any loss of business, capital, profit, reputation or goodwill, arising out of or in connection with GASR or any indirect or consequential loss or damage at all.
4. EXCLUSION OF WARRANTIES
4.1. The End User acknowledges and agrees that GASR is provided “as is”, “as available” and with all faults and is provided without any covenants, promises or guarantees as to accuracy or completeness of the data. Any conditions, terms or warranties as to the same implied or imposed by statue or common law are hereby excluded to the fullest extent permitted by law.
5. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
5.1 GBG does not use Sub-processors to provide this element of the Service as GASR is hosted by GBG.
6. TERMINATION
6.1 Notwithstanding the termination provisions between GBG and the End User in the General Terms, under the terms of GBG’s agreement with the Data Supplier, the supply of GASR can be terminated on 3 months’ prior written notice.
