The Supplier Data that GBG uses to provide Data Maintenance Alerts is supplied by GBG’s Data Supplier. GBG is obliged under the terms of its agreement with its Data Supplier to ensure that all End Users agree to comply with the provisions set out below. These terms apply to all Data Maintenance Alerts checks. Individual Data Maintenance Alerts checks are identified by an ID Number on the End User’s Order Form.

1. DEFINITIONS
1.1. In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms:
“Permitted Purpose” means use of the Data Maintenance Alerts solely for the purpose of account management, tracing, retention and verification.
“Data Maintenance Alerts Data” means the data supplied by GBG’s Data Supplier concerning information or indicators relating to pre-sale, sale or rental of a property in the United Kingdom.

2. USE OF THE SUPPLIER DATA
2.1. The Supplier Data may only be used for the Permitted Purpose in accordance with these terms.
2.2. The End User shall not:
(a) modify, adapt, develop, reverse engineer, decompile or disassemble the Data Maintenance Alerts Data;
(b) copy the Data Maintenance Alerts Data or any part of it unless expressly permitted to do so by this Agreement;
2.3. The End User undertakes, warrants and represents that the materials and message delivered to customers of the End User is the responsibility of the End User and that such materials and message must not expressly state knowledge of a specific house transaction or that the property is known to be in the process of a legal conveyance (by way of example only, it must not state “it looks like you’re moving house”).

3. END USER OBLIGATIONS
3.1. The End User warrants that it will not use the Data Maintenance Alerts Data outside of the Permitted Purpose and that it shall use all due care and skill in using the Data Maintenance Alerts Data in accordance with these terms and the General Terms.
3.2. The End User acknowledges and agrees that the Data Maintenance Alerts Data is provided “as is” and GBG’s Data Supplier makes no representation, warranty, promise or guarantee of any kind concerning the Data Maintenance Alerts Data, whether express or implied by statute, common law, custom, trade usage, course of dealing or otherwise, all of which are hereby excluded to the fullest extent permitted by law.
3.3. If requested by a regulation or statutory law, the End User shall destroy, delete and purge all data or Confidential Information disclosed or supplied to the End User by GBG in connection with the Data Maintenance Alerts Data.

4. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
4.1. GBG does not use Sub-processors to provide this element of the Service as the Supplier Data is hosted by GBG.
4.2. If the End User is contacted directly by a Data Subject who does not wish for their address to be processed under this Dataset, then the End User shall email dmalertsuppression@gbgplc.com detailing the full address that should no longer be processed. GBG shall ensure the address and associated data is suppressed and is excluded from any further processing offered under this Dataset.

5. TERMINATION
5.1. Notwithstanding the other termination provisions in this Agreement, under the terms of GBG’s agreement with its Data Supplier, the supply of the Data Maintenance Alerts Data  may be terminated at any time by giving one months’ notice or suspended immediately if a regulatory body recommends or requires cessation or cancellation of the supply of the Data Maintenance Alerts Data.
