GBG is obliged under the terms of its agreement with its Supplier to ensure that all End Users agree to comply with the following licensing provisions:
1. DEFINITIONS
1.1 In these Additional Terms, the following definitions shall apply, in addition to the definitions set out in the General Terms and Product Terms:
“End User Data” means any data provided to GBG by the End User for processing for the Historical & Current Electoral Roll (Full) element of the Service, in accordance with the terms of the Agreement including where relevant any personal data.
“Permitted Purpose” means the purposes, restrictions and/or conditions for the use of the Dataset outlined by the Supplier as set out in the Additional Terms below in addition to the Customer Use Case set out in the Agreement.
2. USE OF THIS DATASET
2.1 The End User acknowledges that this Dataset must only be used for the Law Enforcement Customer Use Case.
2.2 The End User shall not sell, transfer, distribute or otherwise make the Supplier Data or Dataset available to, or use the Supplier Data or Dataset on behalf of, any third party.
2.3 The Supplier may from time to time change the content of the Supplier Data and/or upgrade or modify any of the methods used to access the Supplier Data.
2.4 The End User acknowledges that the Supplier Data is provided “as is” without warranty of any kind.
2.5 The End User must immediately notify GBG as soon as it becomes aware of, or has reason to suspect, there to have been breach of these Additional Terms or the General Terms.
2.6 The End User may not make any representation in respect of the Supplier Data.
2.7 The End User warrants that it will not use this Dataset for any reason outside of the Permitted Purpose.
3. DATA PROTECTION AND COMPLIANCE WITH RELEVANT LAWS
3.1 Notwithstanding the data protection provisions between GBG and the End User in the General Terms, the End User acknowledges and accepts that the Supplier for this Dataset has appointed GBG to act as a data processor in relation to Supplier Data and that both the Supplier and GBG have entered into a legally binding written agreement to ensure compliance with Applicable Data Protection Laws.
4. TERMINATION
4.1 Notwithstanding the termination provisions between GBG and the End User in the General Terms, under the terms of GBG’s agreement with the Supplier, the supply of the Supplier Data can be terminated on 6 months’ notice.
4.2 The End User acknowledges that the supply of the Supplier Data by the Supplier and use thereof is governed by various statutes regulatory requirements, codes of practice and guidelines relating to the use, provision and sharing of personal data and that the regulations may change from time to time. The End User agrees that the GBG may cease providing the whole or part of the Dataset (without liability) if necessary, in order to enable the Supplier to comply with the relevant regulations.
